1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Babylon Ventures LLC ("we," "our," or "us") regarding your use of the ASCEND mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

ASCEND is a calisthenics training application that provides workout programs, skill progression tracking, and fitness analytics to help users master bodyweight exercises and achieve their fitness goals.

3. Health and Fitness Disclaimer

ASCEND is intended for general fitness purposes only. The App does not provide medical advice, diagnosis, or treatment.

  • Consult a physician before starting any exercise program
  • You are solely responsible for your physical condition and safety during workouts
  • Listen to your body and stop exercising if you experience pain or discomfort
  • We are not liable for any injuries that may occur during or as a result of using the App

4. User Accounts and Subscriptions

  • You may be required to create an account to access certain features
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information during registration
  • Subscription fees are billed according to your selected plan
  • You may cancel your subscription at any time through your app store settings

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Transmit or upload any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use the App to harass, abuse, or harm others
  • Redistribute or resell access to the App

6. Intellectual Property Rights

The App and its content, including workout programs, skill progressions, and functionality, are owned by Babylon Ventures LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and share information about you.

8. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless Babylon Ventures LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice.

You may stop using the App at any time. Upon termination, your right to use the App will cease immediately.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date.
